Using an Immigration Attorney

Although it is not mandatory that you have US immigration attorneys to represent you, there are areas in the immigration process that can be too complex for someone not familiar with the U.S. immigration process.

The U.S. Immigration Process

The US immigration process is not as straight forward as that of some other countries. US immigration is a lengthy and complex bureaucracy process consisting of multiple departments and multiple steps and procedures. Any mistakes or incomplete forms can delayed the process and in some cases may disqualify the application.


For these reasons, even though the USCIS does not require you to use an attorney, you would be strongly advised to use the services of an authorized U.S. immigration attorneys, or immigration lawyers, as US immigration is an extremely complex process. So there will be occasions where the services of a lawyer would prove invaluable. There are some areas that are fairly easy to handle and there are some that would be best handled by an experienced immigration lawyer or immigration attorney.

Family Based Immigration

There are certain types of immigration applications such as family based immigration which can be fairly straight forward and may not require the services of an employment attorney/lawyer. However, even in this category there are situations when using the services of an immigration attorney will be money well spent. For instance:

  • If you are to appear before an immigration judge regarding a deportation notice.
  • You have a criminal record.
  • There is a problem with your immigration papers.
  • There are some technical issues regarding your application.

Immigration Lawyers

Human nature is such that many of us have a misconception about lawyers. We only go to lawyers when we run into problems. We often do not realize that lawyers spend a great deal of their services in preventing things from going wrong. The decision you are faced with in your US immigration application is whether on not to use the services of US immigration attorneys to advise you on your options to ensure that application is problem -free. Or, do you wait until there’s a problem in your application and only then use an immigration attorney or lawyer. There are some mistakes once identified could be terminal for your immigration application.
